Follow these simple steps to purchase WeatherNet. Fill out and submit the following service agreement application. Return to the CATALOG PAGE and complete the order process. Wait for email confirmation and access code; then download client software. In order to purchase and use WeatherNet you must agree to the following TERM & CONDITIONS: 1) Customer is responsible for the payment of charges for all products and services furnished to customer under this agreement. WeatherNet content downloads are charged on a per item basis and will be billed monthly to the credit card number you have provided. Should this credit card number be invalid, declined, or expired at time of billing a 10% late fee will be assessed if full payment is not then received within 60 days. Any applicable federal, state, local and/or foreign taxes, fees and surcharges will be added to the customer’s monthly bill as necessary. 2) Customer agrees to request/review his/her invoice to verify accuracy within 45 days of billing and notify OCENS immediately of any discrepancies contained therein and to request any compensation due. 3) Customer agrees to indemnify, hold harmless, and defend OCENS against any claims resulting from or relating to customer’s breach of this agreement or misuse of the WeatherNet service or other equipment or services used in connection with WeatherNet service. 4) OCENS parties shall not be liable for any harm, loss, liability, damage, expense, cost, suit, claim or demand whatsoever. Under no circumstances will OCENS be liable for any indirect, aggravated, exemplary, punitive, special, incidental or consequential damages (including damages for lost profits, lost revenues, lost information, business interruption, failure to realize anticipated savings or any other commercial or economic loss), or third party claims, expenses, costs, liability, loss, or damage whatsoever, whether arising in negligence, tort, statute, equity, contract, common law, or any other cause of action or legal theory, even if OCENS has been advised of the possibility of such damages. Customer agrees, acknowledges and confirms that the limitations of liability set out in this agreement are fair and reasonable in the commercial circumstances of this agreement and that OCENS would not have entered into this agreement but for customer’s agreement to limit OCENS’ liability in the manner and to the extent provided for herein. 5) $30 and $75 data services card valid for three and six months from date of card activation, respectively. Other data services cards valid for one year from date of card activation. Card must be activated within six months of date of purchase. Funds left on card after expiration date are non-refundable and do not roll-over to next period. Downloads conducted after the data services card has expired or reached zero balance will be billed directly to user's credit card at full rate displayed within WeatherNet file list.
